Fair use of copyrighted material?

This message aims at: reporting the permission from a website to use their pictures on Numista

I found this link, and it's very interesting, it seems I can use any image for my documentations, since they are used for non commercial purposes and I don't enrich myself in any way and as such Numista neither!

Try to have a look. It's worth to have somebody with an adequate legal background to look into this text, I think?

Don't know which laws govern Numista, it's registered in France and the servers are currently in Canada.

… and Canada use the “Fair use etc…” as well.

 

So do we have any legal professionals amongst the numista members to try to clear this up? I suppose, we'll ever know, since we all hide behind avatars and pseudos!

I have no idea about legal stuff. But isn't Numista enriching itself because it shows ads on its website?

 

Bigger database with more pictures → more attractive for users → more clicks → more money through ads

With registration in France, I would guess that French law would govern numista.

A valid argument, I believe, but not valid for me, since I create the documentations (adding my own “value” to non artistic images) and I don't get paid anyway, I only enrich numista and it's members with my non-commercial documentations of varieties, but not myself. 

 

An interesting question, should Numista pay me, if I draw new members because of the documentations, or not? I don't think so, since we are still in educational documentations for all members' benefits. Since I don't copyright my enrichment of used images, I think, I at least as a physical person is not prone to be punished by any copy right laws?

I reassure you only Numista (French single-member limited liability company) would take a legal risk here, as it is the publisher of everything which is on the website. 

As an individual, you could only be held responsible for crimes like hateful texts, forbidden images etc.

Canadian laws applies to all the activity taking place in Canada regardless where the registration of the entity is. Name me one country that would not apply it's own laws to what is taking place inside their border ?!?

Rejected as it is not a source addition.

 

Fair use, Commercial, Non-Commercial do not have the same definition depending on the country. CC licenses basically define Non-Commercial as “not primarily intended for profit”.

 

We keep going with approved sources for the ones listed by/on Numsita.

As long as a source agrees to the use, a documentation can be a one-time agreement as it is done currently.
