W 1180 r. Henryk został wygnany z Imperium. Tytuł księcia Saksonii przeszedł na hrabiego Bernarda z Ballenstedt, który jednak panował tylko nad częścią dawnego księstwa na wschodzie i północy. Henryk ze swojej strony zachował ziemie alodialne wokół zamków Brunszwik i Lüneburg.
